(1) These General Terms and Conditions (hereinafter: "GTC") apply to all contracts, deliveries, and other services of Dopfer, Michael and Rosin, Tomer GbR, Kronberger Straße 2, 65812 Bad Soden (Taunus) (hereinafter: "Miroar"), in relation to its customers regarding the sale of goods through the shop at www.Miroar.de and all sub-domains belonging to the domain. Deviating customer regulations do not apply unless Miroar has explicitly confirmed this in writing.
(2) For the sake of practicality, these GTC do not use gender-specific language forms. Instead, the generic masculine is used, and all gender identities are equally included.
(3) The business relations between Miroar and customers are subject to the laws of the Federal Republic of Germany. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which they have their habitual residence. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
(4) Individually agreed agreements with the customer (including collateral agreements, supplements, and modifications) always take precedence over these terms and conditions.
(5) The contract language is German.
(6) The customer can view and print the order overview and the General Terms and Conditions. The contract text is not stored by Miroar after the conclusion of the contract and is therefore not accessible to the customer.
(7) The place of jurisdiction is Bad Soden (Taunus), provided the customer is a merchant, a legal entity under public law, or a special fund under public law. The same applies if a customer has no general place of jurisdiction in Germany or if their residence or habitual residence is unknown at the time of filing a lawsuit.
(8) Consumers have the option of using alternative dispute resolution. The following EU Commission link (also called the OS platform) provides information on online dispute resolution and serves as a central point for the out-of-court resolution of disputes arising from online purchase contracts: http://ec.europa.eu/consumers/odr.
(9) Information obligation under the Consumer Dispute Resolution Act (§ 36 VSBG): Miroar is neither willing nor obliged to participate in further dispute resolution procedures before a consumer arbitration board.
(1) Miroar offers customers digitally illustrated, custom-made images, picture frames, and gift vouchers for purchase in the online shop www.Miroar.de.
(2) The contract is concluded in the online shop as follows:
(a) If the customer chooses "PayPal" as the payment method, the contract is concluded at the moment the payment instruction is confirmed to PayPal.
(b) If the customer selects "Credit Card" as the payment method, the contract is concluded at the moment the credit card is charged.
(c) If the customer chooses "Sofortüberweisung" (instant bank transfer), the contract is concluded at the moment the payment instruction is confirmed to Sofort GmbH.
(d) If the customer selects Giropay, the contract is concluded at the moment Giropay confirms the transfer.
(e) If the customer chooses "ApplePay," the contract is concluded at the moment the payment method stored with ApplePay is charged.
(f) In all other cases, the purchase contract is concluded upon acceptance of the customer's order by Miroar. Miroar is entitled to accept the offer contained in the order within two working days by sending an order confirmation.
(3) Upon confirmation of the contract conclusion, the customer receives the contract text, these General Terms and Conditions, and the cancellation policy.
(4) In the online shop, customers can also purchase vouchers (by post or digitally). The redemption of vouchers is subject to the following provisions:
(a) The voucher contains a code that can be redeemed in the online shop.
(b) The voucher is only valid for a single use and must be redeemed before completing the order process.
(c) The voucher is transferable. Miroar may perform obligations to the respective holder with discharging effect unless Miroar is aware or grossly negligently unaware of the holder’s lack of authorization, incapacity, or lack of representative authority.
(d) Voucher balances are neither paid out in cash nor earn interest.
(e) The voucher is redeemable until the end of the third year following the year of purchase.
(1) Unless otherwise stated, the desired image is illustrated by hand within 3 to 4 business days after payment and sent to the customer via WhatsApp or email for approval before printing. The illustrations are created by artists commissioned by Miroar, to whom the customer's provided images are forwarded.
(2) After receiving the draft, the customer can request changes within Miroar's capabilities unless it is unreasonable for Miroar. Miroar will review the request and inform the customer within one business day whether the requested change is feasible.
(3) Any changes made will be sent back to the customer for final approval before printing and shipping.
(4) If the customer is dissatisfied with the final draft despite modifications, they may withdraw from the contract unless they have already approved the image for printing. The cancellation must be in text form (e.g., WhatsApp message or email). In such a case, Miroar will refund the customer’s payment, with no further claims applicable.
